An Overruling of Present Medical Procedures is Disregard of Medical Rules
病患被診斷出有心肌梗塞症狀及其他心臟血管疾病，後更被檢驗出有嚴重的三尖瓣閉鎖不全症狀。然而，病患接受心臟手術時，醫院並未注意到既有的醫療衛生標準，多次造成病患其他病變而死亡。最高法院認為，第二審法院忽略了原告在訴狀所載內容及其委託私鑑定人所提之鑑定意見，對事實的認定有所欠缺。對醫療行為的未注意，不以醫師有被強制要求為要件，而在其治療時違反既有的醫療標準即為已足。
The patient was diagnosed with Myocardial Infraction (MI), and other Cardiovascular diseases. He was also diagnosed with a serious Tricuspid Regurgitation later. When he had a heart surgery, however, the hospitals didn’t abide by the medical rules and it caused the patient’s other symptoms which resulted in the death. The supreme court asserted that the 2nd court ignored the materials which was offered by the plaintiff and the opinions of the private appraiser and it lead the failure in the fact-finding. Disregard of present medical rules by medical personnel doesn’t request a special responsibility instead of an overruling of present medical procedures.
