由於精神疾病患者可能因疾病之影響造成自身或他人危險,此時有行保護性治療之需求,故1990年第一版精神衛生法乃針對「強制住院」制度訂出規範,但該制度對於人權的保障不足。因此,2007年版精神衛生法復對於病人治療權及人權提供更完善之規範,而「醫院評鑑」、「機構輔導訪查」與「機構設置標準」則訂定更細緻且明確之機構規範及責任。隨著「身心障礙者權利公約」及「去機構化」之觀念引入,精神醫療機構角色,也應從大量收容病患,轉型為「以機構為據點」,結合在地之社區資源,提供精神病患者醫療、復健與轉介等全方位服務。

英文摘要

Psychiatric patients may cause risk to themselves and others due to illness progress, which need to be treated in a protective environment. The first edition of the Mental Health Act was implemented in the 1990. It sets out relevant regulations for “compulsory admission,” but it is obviously insufficient for the protection of patients’ human rights. Therefore, major revision of the Mental Health Act in the 2007 in order to protect patients’ treatment quality and human rights. Other specifications such as “hospital assessments,” “institutional counseling visits,” and “organization setting standards” provide more detailed and clear institutional norms and responsibilities. With the introduction of the “Convention on the Rights of Persons with Disabilities” and the “deinstitutionalization” concept, the role of the mental health institutions may transform from a large admitted hospital to “institutional support,” which combine local community resources to provide multiple services such as medical treatment, rehabilitation and referral for mental patients.
