醫師的保密義務是醫師的基本醫學倫理,可謂是醫病間信任之磐石。但病人之隱私權之保障並非絕對,當與更高之公共利益衝突或與更高之個人法益衝突時,國家是否應該直接賦予醫師對可能潛在被害者提出警告,如美國加州醫師所要求之警告義務,或者如德國或美國俄州之堅持,確保醫師之保護義務,讓醫師依其個案判斷,決定是否揭露病人隱私,向有爭議。本文認為德國以緊急避難模式可供參考,賦予醫師得利益衡量之權限,決定是否揭露病人隱私以避免第三人之危險,因醫師是最接近病人疾病之人,最能評估其與病人間之信任關係,是否能繼續治療病人,仍以治療病人為第一優先。

英文摘要

Medical confidentiality is the doctor’s basic medical ethics and can be described as the foundation of trust between doctor and patient. However, the protection of patients’ personal rights is not absolute. If there is a conflict with higher public interests or with higher personal legal interests of the others, it is contentious. Doctors in California have a direct warning obligation to potential victims. Conversely, in Germany, the security of doctors’ confidentiality is priority and the doctor is allowed to decide on a case-by-case, after weighing of Interest conflicts between the patient and the others, whether to disclose the patient’s privacy. I think we can take the German emergency doctrine as a model, that gives doctors the right to weigh up the conflicting interests between the patient and the other party and to decide whether the patient’s privacy should be disclosed in order to prevent the other’s life or health from danger. Because doctors are the people closest to the patient’s illness and can best assess the relationship to the illness whether they could continue to treat the patient should continue to be treated priority.
