某院放射腫瘤科醫師日前於臉書上指出有一名罹患直腸癌的病人,誤信另一名崇尚自然療法知名許姓醫師的醫療廣告,花了上百萬做氣功、服用天仙液、喝電解水,不僅病情沒有起色,最後導致腫瘤復發、移轉及死亡,這起事件引起社會大眾譁然以及衛生福利部的重視。本文將以現有之醫療法、相關醫療機構與醫事人員之倫理守則與判決實務等觀點,分析醫事人員之醫療廣告責任,以期杜絕叢生之亂象。

英文摘要

Recently, a radiation oncologist revealled on the Facebook that one of his patient, who had sufferd from rectal cancer, mistakenly believe in a well-known natural therapy physician, though spending a million dollars in Qigong, Tien Hsien Liquid-P and Electrolye water, the patient get worse instead of improvement. This event result in causing profound public outcry and drawing intense attention of Ministry of Health and Welfare. This article is to discuss legal liabilities and ethics of medical personnel involved in medical advertising.
