The Basic Legal Principle of Compulsory Medical Treatment of Mental Disorders
法律原則是一法律體系中作為規則的指導思想、基礎，或本源的、綜合的、穩定的法律原理和準則。法律原則無論是對法的創制，還是對法律的實施都具有重要意義。針對精神障礙者之強制醫療一直是社會各界關注的熱議焦點，然而與精神障礙強制醫療的基本法律原則相關之探討卻很少，所以需要吾人歸納與探尋，以期成為指引精神衛生法實踐的精神指南。
The principle of law is a comprehensive, stable legal principle and criterion that is the guiding ideology, foundation or source of legal rules in a certain legal system. The legal principle is of great significance to the law and the implementation of law. For people with mental disabilities compulsory medical treatment has always been the hot topic in the social from all walks of life, however, on the basic of compulsory medical legal principles is rarely discussed. So we need to generalize and explore, with a view to becoming a spiritual guide to the implementation of the mental health law.
