Manufacturers’ No-fault Product Liability of Dietary Supplement Products under Taiwan Consumer Protection Act
消費者食用欠缺安全性之健康食品而受有損害，得依消保法第7條，對從事設計、製造或生產之企業經營者主張商品無過失責任。本文探討消費者主張商品無過失責任之構成要件，以及其所面臨損害與因果關係舉證上之難題，並參酌食安事件相關法院實務判決，提出建議。
When a defective product of dietary supplement causes injury on consumers, the manufacturer of the product is liable under Article 7 of Taiwan Consumer Protection Act. This Article reviews the elements of products liability law of Article 7 as claimed by injured consumers, and the difficult challenges faced by them regarding the burden of proof. Finally, it will offer some thoughts and suggestions.
