The Rule of Reliance in Medical Teamwork
信賴原則之法理係基於適當分配交通危險的概念而衍生，在學說及實務上，多肯定信賴原則應可適用於交通事故以外，諸如醫療行為這類同具分工合作性質之其他領域。醫療行為接受信賴原則之目的在於，可在複雜的醫療組織中合理劃分醫療人員在個別專業領域中所可預見之注意義務範圍與應承擔的風險。然而，在判斷信賴原則適用醫療行為與否時，仍須考量該具體事件背後的規範保護目的與價值，才能彰顯容許風險在醫療行為之價值與意義。
The legal principles derived from the rule of reliance are acquired from the concept of appropriate distribution of traffic risks. Most theories and judicial practices agree that the rule of reliance should be applicable to medical behavior. The purpose of accepting the rule of reliance in medical behavior is to reasonably classify the scope of the foreseeable obligations and the risks that medical personnel can foresee in individual professional fields in complex medical organizations. However, when judging whether the rule of reliance applies medical behavior or not, it is necessary to consider the purpose and value that protected behind the event, and therefore be able to accurately demonstrate the value and significance of the tolerable risk in medical behavior.
