The Civil Obligation for the Intern Physician Who Practiced Independently
在醫療機構高度分工的情況下，各部門之上級醫師對於下級醫師應有指示、監督之義務，不得任由新手醫師、不具備醫師資格之實習醫師等，在未受指示監督即獨自執行醫療業務，倘應在勤之主治醫師未親自到場診療，復未給予在場之新手醫師、實習醫師等充分指導，就病患因此所受損害應有過失。而醫院必須對各部門醫師之排班、到勤等事項善盡其管理責任，此亦屬醫院應盡之行為義務，且不能僅以人力不足為由，作為醫院任由實習醫師在未受指示監督下，獨自一人執行醫療業務之正當化事由。
Because of the high division of labor in medical institutions, the superior physician in every department have the duty of instructions and supervisions to the subordinates. Without it, it is not allowed that a greenborn physician or an intern who has no certification of physician practice medical treatments independently. If a chef physician who is on duty gives medical treatments in person, but lacks of full instructions to the greenborn physicians or the interns, he might have the negligence to the damage the patient have had. Besides, the hospital must be conscientious about the scheduling of the physician in departments and attending, which belongs its duty. Being lack of human power shouldn’t be the reason to justify the medical practice by an intern physician independently without supervision.
