論失智症患者之刑事責任──評臺灣高等法院臺南分院107年度上訴字第934號刑事判決【醫法新論】 試閱
On the Criminal Liability of Dementia Patients: Comments on the Judgment of Taiwan High Court Tainan Branch Court Shang Su Zi No. 934 (2018)
隨著失智症人口之快速增加,其不僅對醫療及公衛體系造成衝擊,對司法體系而言亦產生諸多挑戰。而其中,在刑事司法領域,值得探究的問題即是:當失智症患者是為犯罪行為人,其犯罪行為可能對於刑事訴訟造成什麼樣的挑戰,進而在刑事司法程序上又應為如何之應對?對此,本文從醫學上對失智症之成因及其特徵出發,觀察其對刑事司法所造成之挑戰,進而分析比較法上刑事司法體系如何面對及處理失智症所帶來的挑戰及問題。最後,再回到本文之具體案件—臺灣高等法院臺南分院107年度上訴字第934號刑事判決,對此案進行評析。
The sharp increase in the number of dementia patients has not only brought about impacts on the medical and public health systems, but also created various challenges to the judicial system. Among such challenges, a question worth examining in regard to criminal justice is: When the perpetrator of a crime is a dementia patient, what challenges might their criminal behavior cause to the criminal proceedings? Also, what adjustments, if any, should the criminal justice procedures adopt in response to these challenges? In this regard, the present research approaches the issue by reviewing the medical causes and characteristics of dementia and outlining the challenges it poses to criminal justice. The research then analyzes how the criminal justice system tackles the challenges brought about by dementia in terms of comparative law. Lastly, comments on a specific judgment made by the Taiwan High Court Tainan Branch Court in 2018 are presented to support the statements made.
