<p style="font-size:17px;"> 医疗过失之判定，本质上具有「专业性」、「个案性」及「多样性」等特质，法律上判断极不容易，如何建立一个明确且具法安定性之判定体系，对于医、病、法三方无论在实体法或程序法上之利益皆极为关键。由于医疗纠纷之争点极为庞杂，将医疗争议予以类型化，或许系一可行之切入点。 本讲座将聚焦于英美法、德国法、日本法及台湾法律关于医疗过失之基础理论及诉讼案例，并尝试融入医疗临床工作者之视角，将医疗民事纠纷之争点类型化，以建立医疗民事责任过失判定之操作体系，俾供学界及实务界参考。</p>
