<p style="font-size:17px;">商标法第71条第1项第4款为商标侵权下合理权利金相关损害赔偿之法源，自 2011年增订后，至今已有将近十年，这段期间内台湾司法实务累积了一定程度之判决案例，判决中亦呈现出法院对于合理权利金相关损害赔偿之诠释与立场。本周介绍沈宗伦教授在『商标侵权之合理权利金损害赔偿：美国联邦商标法与台湾实务现况』讲座中，提出对于美国联邦商标法合理权利金损害赔偿的原则及主轴。<br /> 在『商标侵权之合理权利金损害赔偿：美国联邦商标法与台湾实务现况』讲座完整影音内容中，沈教授从比较法的观点，聚焦于美国联邦商标法及其相关司法实务，酌参学理，探索商标侵权与损赔偿之关系，以及合理权利金损害赔偿之功能与计算，再以美国法之研究视野作为借镜，比较观察台湾相关判决之发展。</p>
