2011年增訂後，至今已有將近十年，這段期間內我國司法實務累積了一定程度之判決案例，判決中亦呈現出法院對於合理權利金相關損害賠償之詮釋與立場。本講次主要以比較法的觀點，聚焦於美國聯邦商標法及其相關司法實務，酌參學理，探索商標侵權與損賠償之關係，以及合理權利金損害賠償之功能與計算，再以美國法之研究視野作為借鏡，比較觀察我國相關判決之發展。</p><br /><h4 style="color:
