| （一）版 本 本書乃元照出版公司授權中國大陸法律出版社之簡體 中文版，未來仍有英文等其他外文版本。 （二）書 名 本書以英美法辭典題名，所稱英美法包括英格蘭法、 威爾士法與美國聯邦法及州法，兼指身受英美法影響並同 屬普通法體系的加拿大、澳大利亞、紐西蘭等國之法律。 （三）編 纂 本詞典編纂肇始於1994年，歷經八載，於2002年末始 定稿。主編除邀請中國政法大學、北京大學、中國人民大 學、中國社會科學院等單位法學教授、研究員外，並慎選 法學碩士、博士研究生等參與其中，先後達兩百數十人， 依主編策劃部署，分工合作；主編並遠赴京、滬、杭、寧 、港、臺各地找尋對英美法素有學養之老學者進行審定重 任。 （四）資料來源 本詞典蒐整資料來自19世紀以來之英美法詞典、百科 全書、判例集、法律彙編、各部門法學專著，並旁及加、 澳、紐等國之法律詞典、法律專著，綜合編纂。 （五）收錄內容 1.本詞典收錄十萬餘詞條，內容兼容羅馬法、大陸法 、古法因為「以判例法為基礎的英美法迄今仍未全部逃避 羅馬法的影響」，並且在當代與大陸法有趨同之勢，再立 法與實踐上日益交錯。故本書收錄相當數量蘇格蘭法、德 、義、西、葡等大陸法詞目，尤其是羅馬法、歐洲古法、 封建法、教會法等。 2.本詞典收錄法律格言，因為作為法律文化遺產，它 是傳統法律的原則，是簡潔凝練的箴規，多來自羅馬法， 為拉丁文；少數來自英國，為英語；或作諾曼法語。該部 份只在裁決案件中適用該法律的範疇內始成為法律，當今 法律格言的地位遠遜於前，但在法律著述與研究中仍占有 重要地位。 3.本詞典收錄英美兩國法院組織、法官、律師、陪審 團以及美國法典大要、美國判例集、土地權利等的圖示， 同時對英美基本法及其法制史上重要文獻均收錄其中。 |
