從平等原則探討物理治療師業務之屬性【本期企劃】 試閱
Discussion on the Attributes of Physical Therapists’ Business from the Perspective of Equality Principle
我國已是人口老化的「高齡社會」，老人容易肌少、摔倒、筋膜發炎、肌腱沾黏、五十肩、中風等，須賴物理治療予以緩解疼痛、復能，以恢復正常生活。我國衛生法規對於醫事人員的管制規定，固有其追求公共利益之目的，但由於各醫事人員專法制定、修正時間，以及修正頻率不同，甚至有特殊的不當考量，致使部分法規，相同的事理而為不同的規定，有違平等原則。關於物理治療師的業務執行，是否全屬「醫療行為」，應一律「依醫師開具之診斷、照會或醫囑為之」而無獨立行使之餘地，不無爭議，本文爰自物理治療師法之管制密度及與醫事人員專法間的水平平等角度，探討此項議題。
Taiwan has been an aged society already. Sarcopenia, faciitis, tendon sticking, frozen shoulders and strokes are commonly found among old people. Physical therapy becomes a vital measure to help them relieve pain, regain body functions and restoe their normal lives. Regarding the management of medical personnel, our health care regulations were supposed to pursue public interest. However, because of the timing, the situation, or even interventions by interest groups, some of the legislations of each different medical personnel revealed unfair contents which conflicts the equality principle. With regard to the treatment of physical therapists, whether they are pure “medical behaviors,” which “shoud be done in accordance with physician’s diagnosis, notes or orders” and without independent judgement? This is not indisputable. So this article is to discuss the above mentioned issues through the control density of Physical Therapists Act and the equality between this and other medical professionals acts.
