Walking in the Gray Area of Law and Life, the Dilemma of Clinical Discretion in Emergency Medicine
急診專科醫師因其專科特質，與病患和家屬間往往缺乏互信關係，容易使醫病關係陷於緊繃。本文藉由討論急診臨床上常見的困難決策議題，加之以近來的急診實務判決作為參考，討論急診醫療訴訟可能的成因，包括急診在考慮是否急救、是否檢查、是否留院觀察時的醫療裁量困境，以求第一線的臨床醫師握有更具體的行為準則參考，並使病患就醫環境更獲改善。
In the emergency room, there is often a tense relationship among patient, family and physician because of the lackof trust between those different parties and the patient critical condition. This article lists three common clinical discretionary situations in emergency medicine: resuscitation, examination, and observation. It further analyzes why these could cause potential legal disputes. Pointing out legal risks to emergency room physicians could enable them to work with better confidence, and offer a safer medical environment to the public.
