An Analysis of Legal Liabilities on Advocating Traditional Medicine—A Case Study on an Youtuber Sharing the Experience of “Liver and Gallbladder Flush”
Traditional medicine, or so-called complementary and alternative medicine, has been ubiquitous in our daily life. It provides choices other than conventional medicine and enhance the right to bodily autonomy. However, traditional medicine does not have solid basis as conventional medicine do, such as the professional system and scientific evidence, and thereby also brings risk to public health. The regulation over traditional medicine is serious regulatory issue. This article examines the abovementioned regulatory issue through a case study on a Taiwanese influencer’s video sharing her experience of “liver and gallbladder flush”. The article addresses the relevant regulation over medical treatments as well as food and drug products, and also analyzes the issue from the view of freedom of speech.
