The Ethical and Legal relationship of patients discharged against medical advice from Emergency Department
In the emergency room, there is often a lack of trust among patient, family and physician because of short emergency room stay length. Patients may want discharge when they refuse further treatment or observation. Although physicians have no right to keep patient at emergency room, there could still be potential medical disputes and legal risks after an against advice discharge. This article proposes an algorithm in the setting of against medical advice discharge. Clarifying legal and ethical relationship in these situations helps to improve the efficiency of medical resource use and improve patient-physician relationship.
