臺灣腦庫的建置，對於我國腦神經醫學及腦疾病的治療極為重要，對於腦庫運作時可能產生的法律問題或倫理爭議，若能預先探討與釐清，必有助於未來腦庫的順利發展。較為重要的問題有：腦組織的捐贈與採集，以及與解剖屍體條例間的適用關係、超出原先預設使用目的之處理方式、捐贈者與家屬能否享有返還腦組織或檢體的撤回權等，都有必要進一步的探討與分析。
The establishment of Taiwan Brain Tissue Resources Center (TBTRC) is extremely important for the treatment of brain neuro medicine and brain diseases in Taiwan. The clarification of legal issues or ethical disputes that have formed in it will inevitably contribute to the smooth development of TBTRC in the future. The particularly important issues such as: The relationship between the collection of brain tissue and Human Autopsy Act, the handling for use beyond the original purpose of collection, whether the donor and family members can enjoy the right to withdraw the brain tissue or specimens, etc., are all need further discussion and analysis.
