落實護理倫理應從重視醫護專業法規教育起—兼評「臺灣護理倫理規範」【月旦時論】 試閱
Implementing Nursing Ethics Should Begin with Emphasizing Education on Medical and Nursing Professional Regulations—A Review of the"Taiwan Nursing Ethics Code"
內政部公布2025年12月底,我國65歲以上人口數比率達20.06%,邁入「超高齡社會」,失智症盛行率7.99%,醫療照護或長期照顧需求,都面臨更大的挑戰。我國醫師倫理規範及護理倫理規範增訂、修正,前者,強化與鞏固專業法規之地位與遵從義務;後者,規範內涵有許多未周之處,未強調專業法規之拘束力,對於老人醫療照護上應關注事項,以及避免虐待的發生,並未著墨。
醫事人員應具備專業知能,以及專業法規、勞動法規等相關法律知識,以確保「依各該醫事專門職業法規規定,執行業務」,亦能適時向違法之雇主主張權益,實現病人及自身的醫療人權。落實護理倫理,關鍵在於重視醫事人員醫護專業法規教育,而非將法規教育作為倫理課程之附屬品。
According to the Ministry of the Interior, by the end of December 2025, the proportion of my country’s population aged 65 and over will reach 20.06%, entering a “superaged society,” with a dementia prevalence rate of 7.99%. This presents greater challenges to medical care and longterm care needs. Taiwan’s Code of Ethics for Physicians and Nurses has been revised and expanded. The former strengthens and consolidates the status of professional regulations and the obligation to comply; the latter has many shortcomings in its content, failing to emphasize the binding force of professional regulations and neglecting to address key considerations in elderly medical care and the prevention of abuse. Medical personnel should possess professional knowledge and relevant legal knowledge, including professional regulations and labor laws, to ensure that they “perform their duties in accordance with the relevant medical professional regulations” and can also assert their rights against employers who violate regulations, thus realizing the medical human rights of patients and themselves. Implementing nursing ethics hinges on emphasizing the education of medical personnel in medical and nursing professional regulations, rather than treating legal education as an adjunct to ethics courses.
