Criminal Negligence and Therapeutic Care of Mentally Ill Patients: An Analysis Based on Practical Cases
精神科的病患具有多樣性,有的病患有認知情緒需要協調處理,有的病患的病症不易掌握,因而精神科醫療與照護團隊成員與病患之間的關係,其複雜程度遠高於其他科別,從而在醫病關係與病患安全的處理上更為棘手。本文首先簡略介紹精神疾病患者的風險行為特徵,然後提出二則判決案例,第一個案例探討在醫院有自殺防範設備不足的情形之下,精神科醫療團隊成員的刑事過失責任如何判斷;第二個案例探討對於急性精神病患送入保護室的條件與醫療照顧應注意事項,本文將對兩案判決內容提出具體的評析。
The diversity of psychiatric patients—ranging from those requiring coordinated intervention for cognitive and emotional disturbances to those with unpredictable symptoms—renders the relationship between the psychiatric care team and the patient far more complex than in other medical specialties. Consequently, managing the doctor-patient relationship and ensuring patient safety is particularly challenging. This article begins with a brief overview of the risk behavior characteristics associated with persons with mental disorders. It then examines two judicial precedents: the first explores how to determine the criminal negligence liability of psychiatric medical team members in instances of inadequate hospital suicide prevention facilities; the second investigates the necessary conditions and medical care precautions for admitting acute psychiatric patients to seclusion rooms. This paper concludes with a detailed analysis and critique of the rulings in both cases.
