In this case, the patient developed “acute ulcerative gingivitis of the maxillary central incisor” after undergoing root canal treatment at a dental clinic, resulting in gum tissue ulceration. The patient filed a civil lawsuit, alleging that the dentist had caused the injury by using a high-speed suction device to remove excess sodium hypochlorite solution during root canal irrigation, without first isolating the area with a rubber dam. The dispute centred on whether the dentist had followed medical standards and whether such an injury was an unavoidable risk inherent in the treatment process. While the court found that this was an unavoidable risk and that there had been no violation of medical standards, negligence or liability on the dentist’s part, the criteria for what constitutes an “allowed risk” in any medical procedure remain unclear.
