This article primarily discusses the criminal penalties under the Criminal Code for illegal recording acts that infringe upon privacy, as well as the legal boundaries of private evidence collection. It particularly focuses on the controversies surrounding Article 315-1 of the Criminal Code regarding the crime of recording without reason ,including the criteria for determining what constitutes “non-public activities or speeches” and the interpretation of the “without reason” element. Based on this foundation ,the article further clarifies that when individuals engage in surreptitious recording for the purpose of collecting evidence, such acts are, in principle, only permissible in non-private public spaces, unless there are legitimate grounds for justification.
