2026年5月，知名醫美集團遭揭發於全臺分店設置偽裝針孔攝影機、偷拍顧客私密影像，因而引發社會熱議，希冀能釐清並明確界定醫療場域錄音錄影的合法界線。本文旨在探討基層醫療診所基於保全證據目的所為之攝錄行為，其應負有何種告知義務及應遵循之相關規範。同時就屬非法攝錄所得之影音資料，於刑事訴訟中之證據能力進行討論，以兼顧醫療隱私及證據保全之衡平。
