Identification and Regulation of Legal Risks in Internet Medical Care
Internet medical care has significant advantages in optimizing the allocation of medical resources and alleviating the pressure of medical treatment. However, its characteristics of “transcending time and space”, the participation of multiple subjects and the deep embedding of artificial intelligence technology also bring endogenous legal risks that are difficult to be covered by the traditional medical framework. It is mainly reflected in four aspects: the amplification of subject uncertainty, the increasing frequency of conduct exceeding permissible boundaries, the difficulty of electronic information management and the difficulty of responsibility identification. In response, it should be regulated from four dimensions: strengthening multi-dimensional supervision, improving legislation in a timely manner, strengthening information management and clarifying the main responsibility, in order to achieve a balance between encouraging industry innovation and protecting patients’ rights and interests.
