Review of Medical Institution Photography Standards: Balancing the Rights and Interests of Patients and Providers
Recently, an incident involving a cosmetic clinic secretly filming patients with hidden cameras has drawn widespread public attention. The regulations governing photography in medical institutions have also come under intense discussion. Prior to this incident, the Ministry of Health and Welfare’s 2015 “Regulations on the Protection of Medical Privacy in Medical Institutions” served as the primary guidelines for photography in medical facilities. In the wake of this event, regulatory gaps have come to the forefront. Although local authorities quickly issued corresponding guidelines, these measures remain insufficient. Photography in medical facilities directly impacts patient privacy and personal data rights. It is advisable to establish clear legal grounds that grant statutory authorization to the central competent authority to enact formal regulations and administrative orders, while ensuring that legislation also balances the rights and interests of medical institutions.
