Trends in Multiple Treatments and Practice of Drug Addiction Treatment
毒品危害防制條例針對毒品成癮者改採「多元處遇方式」，其所代表之意涵係過去多將毒品成癮者視為「病犯」，未來將逐步採取「以治療代替刑罰」之刑事處遇。本文除比較兩套體系的差異，同時針對新法之「毒品戒癮治療多元處遇」之立法與未來毒品政策給予通盤之建議，包括：有關「未成癮」之認定標準及權責機關為何？若為醫療機構評估，則相關之人力和經費來源，有待更細緻的規劃。
The Drug Hazards Regulation will adopt a “multiple approach” for drug addicts. The meaning represented is that in the past, drug addicts were often regarded as “sick inmates,” and in the future, criminal treatment of “substituting treatment for punishment” will be gradually adopted. In addition to comparing the differences between the two systems, this article not only provides suggestions for the new law on “Multiple Treatment of Drug Abuse Treatment,” but also provides general recommendations for our future drug policy, including: the criteria for identifying “not addicted” and what is the authority? If it is a medical institution evaluation, the relevant manpower and funding sources need to be planned in more detail.
