Detoxification and the Determination of the Completed Treatment
In accordance with Narcotics Hazard Prevention Act, the prosecutor shall seek the advice of a medical institution when deferring prosecution of a drug user who has completed treatment for addiction. The medical institution consulted shall evaluate the severity of the defendant’s drug use, the presence of mental illness other than drug addiction, treatment planning, and other matters related to treatment for addiction. The drug user has the characteristics of the patient as well as the criminal. Drug addiction is also a chronic illness with relapsing characteristics and requires long-term treatment and assistance.
The treatment to drug addiction is a combination of psychosocial and pharmacological treatment. During the follow-up period, the cooperation with the treatment, the urine screening results, the drug use and physical and mental functioning of the criminal would be evaluated to determine the outcome of the treatment. The penalty as the mainstream treatment to the drug users has been changed to the dualism with the medical treatment and the penalty in Taiwan. It could be enormous progressive in respect of protecting the medical human right to make the drug users to be the addicted patients. It is expected that this kind of approach will help drug users return to the society in a more effective and humane way.
