醫療訴訟中關於診斷錯誤疏失，經常成為請求原因，對於臆診正確性之要求實強人所難也非法律所能要求，但就排除臆診之鑑別診斷並非醫師得恣意選擇，而無視對於患者可能有生命重大急迫影響，並且就鑑別檢查選擇之正確性、告知同意以及安全性，醫師仍應盡一定之注意義務。
In medical litigation, the negligence and error in diagnosis are a cause of action, and the requirement of correctness of impression is too difficult and not required by law. However, a physician may not arbitrarily exclude diagnostic tests during impression-making without regard to the possible critical impact on the patient’s life. The physician still be obliged to fulfill the duty of care while choosing diagnostic test correctly and implementing safely with informed consent.
