Giving up Medical Treatment or Arbitrary Medical Treatment
對於病人的意思決定,醫師本應尊重。但病人基於宗教信仰拒絕醫療時,醫師是否仍應尊重病人放棄醫療的選擇,或是專斷迫使病人接受治療。本文將從醫師為具有耶和華見證人信仰的病人拒絕輸血之例談起,探討醫師若在違反病人信仰的情況下為其輸血,可能觸犯的刑事責任,以及刑法學理上該如何妥當評價。
Doctors should have respect for the patient’s decisions. However, when the patient refuse to receive medical treatment for religious reason, it raised an issue whether the doctor still comply with the patient’s choice of giving up medical treatment or arbitrarily force the patient to receive it. From a case of a patient who refuse blood transfusion as one of Jehovah’s Witnesses, this article would discuss criminal liability the doctor might bear and its proper evaluation if the doctor still do the blood transfusion against the patient’s belief.
