| ■研討會簡介 |
台灣雖非聯合國會員國，就專利法制之運作於亞洲區域向扮演關鍵角色。以2014年為例，經濟部智慧財產局共受理78,014件專利申請案，其中包括46,378件發明、23,488件新型及8,148設計專利。2008年智慧財產法院設立後，每年總計承審超過數百件專利民事及行政訴訟案件，判決見解不僅廣泛觸及專利法各領域爭議，法院就專利法規之解釋亦深深影響經濟部智慧財產局之實務運作及產業界之智財佈局思維，對台灣智財法律之演進產生關鍵影響。在智財法院設立運作屆滿八年之際，經分析歸納數以千計判決見解，最關鍵之爭議，仍在於最基礎之專利法概念，其中尤以申請專利範圍解釋及進步性判斷等兩大議題，影響層面最為廣泛，個案皆難免涉及此等法律概念之適用，而鑑於其高度不確定法律概念之抽象性本質，確實易導致實際操作端之困難。本次研討會特別聚焦於此兩大法律議題，邀請國際專家以每一位至少一小時的時間，完整報告並分享經驗，與會者尚得有充分時間與國際專家深入交流，提問討論。
我們很榮幸能夠邀請美國CAFC的Raymond T. Chen法官（United States Court of Appeals for the Federal Circuit）、德國聯邦最高法院智財庭庭長Dr. Peter Meier-Beck法官（the German Federal Court of Justice）、EPO官方代表Dr. Daniele Semino（Technical Member and Deputy Chair of Boards of Appeal of the EPO）、USPTO官方代表Mr. Christian Hannon（Patent Attorney at USPTO）及跨國企業代表LG公司的副總裁Dr. Joo Sup Kim（Vice President of LG Electronics Inc.）等國際專家，蒞臨研討會擔任報告人。智慧財產法院、智慧財產局及專利師公會亦將有代表對談。本研討會匯集全球兩大專利局、美、德專利專責法官及跨國企業代表齊聚一堂，是國內難得一見的世界級規格，機會難得，期望您的參與，共同為台灣的專利法制貢獻心力！

| ■BACKGROUND OF THE EVENT |
The patent system in Taiwan has been established since the 1940s. In 2014, the Intellectual Property Office (IPO) received a total of 78,014 patent applications. Among those applications, 46,378 were related to inventions, 23,488 were related to utility models, and 8,148 were related to designs. Although Taiwan is not a U.N. member, the country plays an important role in Asian patent practice. Before 2008, patent infringement claims were heard by civil courts while patent validity claims were heard by administrative courts. A very high percentage of civil cases had to be stayed pending the decisions of the IPO and administrative courts on the validity of the patents in suit. At that time, patent infringement litigation could drag on for years, and the protection provided to patent holders was limited. In 2008, the Intellectual Property Court (IP Court) was established to hear both patent infringement and patent validity claims in civil litigation. Since its establishment, the IP Court has heard over a thousand cases. The efficiency of the IP Court has resulted in more timely protection for patent holders.
It is crucial to establish better criteria and principles for judging issues of infringement and validity. Claim construction and inventive step are the two most common and important issues dealt with in each case. The purpose of this seminar is to bring together legal experts and professionals from different countries to share knowledge and expertise on these two issues.
We are pleased to have the presence of the Honorable Raymond T. Chen, Judge of the United States Court of Appeals for the Federal Circuit, Dr. Peter Meier-Beck, Presiding Judge of the German Federal Court of Justice, Dr. Joo Sup Kim, Vice President of LG Electronics Inc., Dr. Daniele Semino, Technical Member and Deputy Chair of Boards of Appeal of the EPO, and Mr. Christian Hannon, Patent Attorney at USPTO, and judges, patent examiners and legal professionals from Taiwan. We hope that this seminar will benefit us all by allowing us to see these two issues in a new light and identify appropriate approaches to address them.
