Systemic Self-Erosion: The Case-Norm Tension in Long-Term Care Homicide
長期照顧服務(下稱長照)情境下之殺人案件,近年於實務中呈現不同犯罪樣態,但未必均源於不可替代之照護壓力。本文自刑法犯罪類型與量刑體系出發,說明長照因素於刑事評價中的功能界線,並指出以個案悲劇性作為通案修正之依據,恐導致刑法評價功能錯置的風險。
Homicide cases occurring in long-term care contexts have increasingly shown heterogeneous patterns in judicial practice and cannot be explained solely by unavoidable caregiving pressure. This article approaches the issue through offense typology and the layered structure of sentencing in criminal law, clarifying the normative function of long-term care factors in criminal evaluation. It argues that elevating the tragic nature of individual cases to a general corrective standard risks a misallocation of evaluative levels, thereby shifting systemic care responsibilities into the realm of criminal law and distorting its normative function.
