The Legality of Online Medical Consultation: At the Intersection of Technology, Medicine, and Law
2024年修正發布「通訊診察治療辦法」,將適用對象放寬,並增加開立處方等項目,代表我國醫療法制正式從「診間物理空間」擴展至「雲端數位場域」。然而,新型態醫療態樣之適法性疑慮伴隨法規開放而來,醫師線上回覆網友之提問屬於「衛教諮詢」還是「醫療行為」範疇?缺乏自然人資格之AI,能否滿足「親自診察」法定要件?
Following the 2024 amendment to the Regulations of Medical Diagnosis and Treatment by Telecommunications, which expanded the scope and included prescribing authority, our medical legal system has officially extended from physical clinics toward digital cloud platforms. This openness, however, creates regulatory uncertainties for emerging medical services. A critical question arises: should a physician’s online interaction with netizens be categorized as “health consultation” or a formal “medical act”? There is the question of whether AI, lacking the capacity of a natural person, can ever satisfy the legal mandate for a physician’s “personal examination.”
