Case Concerning the Legality of the Allocation of Internship Quotas for Foreign (Dental) Medical Graduates: The Administrative Law Court Case of Internship Qualifications for Foreign Medical and Dental Degrees: An Analysis through the Lens of Administrative Due Process
最高行政法院判決再度肯認系爭外國(牙)醫學學歷實習資格標準與分配方式之合法性。依循釋字第750號解釋及行政法院穩定之見解,從最嚴格的實定法角度以觀,該判決並無明顯瑕疵。但若考量整體政策影響層次之廣泛,二十餘年來歷經多次修法與訴訟仍未能真正定紛止爭,故本文從正當行政程序的觀點重新詮釋我國行政法之規範標準,建議主管機關重新考量其決策程序之選擇,並為司法審查在不踰越權力分立界線的前提下,以強化行政決策品質為目標,提供另一種思考與判決可能觀點。
The Supreme Administrative Court once again affirmed the legality of the internship qualifications for foreign medical and dental degrees. Following the reasoning of J.Y. Interpretation No. 750 and the administrative court’s accumulated proposition, the judgment—viewed from the strictest perspective of positive law—shows no apparent flaws. However, broader policy implications are involved, and the issue remains unresolved, in spite of the efforts on institutional reforms and litigations for more than two decades. This article reinterprets the normative standards of Taiwan’s administrative law through the lens of administrative due process. It urges the competent authorities to reconsider their choice of decision-making procedures and suggests that judicial review, while respecting the boundaries of separation of powers, can serve to enhance the quality of administrative decision-making. This article aims to offer an alternative perspective for both administrative practice and legal reasoning.
