法官對於醫療訴訟中對於鑑定意見不應全盤照收，但如何判斷真偽，藥品仿單或醫療器材標籤、說明書承載臨床試驗科學證據之結果，自足以充當法官判斷之重要參考來源，特別是鑑定意見形成所依據之文獻或相關資料之真實性及可信性，均應驗證與本案事實是否相當而可加以援引。
In medical litigation, the judge should not accept all expert opinions. How, however, to determine the authenticity of the drug label or medical device labels and instructions containing the results of clinical trial scientific evidence is sufficient to serve as an important source of reference for the judge to make a judgment, in particular, the authenticity and credibility of the literature or related information on which the expert opinion is based should be verified to determine whether it is comparable to the facts of the case, and can be invoked.
