Guidelines for the Selection and Distribution of Clinical Practical Training for Foreign Medical and Dental Graduates. Plaintiff A, a foreign-trained dental graduate who passed the first stage of the dentist qualification examination, was denied clinical practical training by the Ministry and subsequently filed an administrative lawsuit. The court held that while the Physician Act regulates important matters such as examination qualifications, the Ministry may issue necessary regulations on minor, detailed, and technical matters for the execution of the law. Pursuant to the Enforcement rules for Physicians Act and the aforementioned Guidelines, the Ministry implemented a total quota control mechanism—announcing training quotas annually—based on factors including comprehensive healthcare manpower planning, prevention of workforce imbalances, and limited domestic medical training resources. This measure constitutes a detailed and technical implementation of Article 4 of the Physician Act and does not violate the principle of legal reservation or the requirement for clear legislative authorization.
