傳染病防治法與地方自治體權限分配及問題初探──以COVID-19為例【本期企劃】 試閱
The Issues of Distribute Powers and Authorities between the Central Government and Local Self-Governing Body– The Legal System of COVID-19 Prevention and Control in Taiwan
本文係針對我國「嚴重特殊傳染性肺炎」(COVID-19)的防疫體制進行討論與分析,並指出傳染病防治法在立法上的疏漏之處,以及缺乏與行政組織法學理及地方制度法的整合,因此在國家與地方自治團體之間的權限劃分產生爭議,進而對於防疫工作的推動產生妨害,準此本文亦提出如何解釋法律以解決前述爭議,以及未來的改善方案。
This article discusses and analyzes “COVID-19” epidemic prevention system in Taiwan, and points out the legislative omissions in the“ Communicable Disease Control Act” (CDCA), as well as the lack of legal theory of administrative organization and “Local Government Act” (LGA). Integration, therefore, the division of authority between the state and local governments has caused disputes, which hinders the promotion of epidemic prevention. This article also proposes how to interpret the law to resolve the aforementioned disputes and future improvement plans.
