After Same-Sex Marriage, Before Full Equality: A Brief Discussion on Amending the Assisted Reproduction Act
本論文探討臺灣同性婚姻合法化後,人工生殖法修法的必要性與挑戰。現行人工生殖法僅適用於已婚異性戀夫妻,排除單身女性與同性伴侶,導致同志族群需赴海外尋求人工生殖,承擔高昂費用與醫療風險。2024 年衛福部提出修法草案,擬開放單身女性、女同志配偶使用人工生殖,並合法化代孕。然而,草案仍存年齡限制、資訊揭露不足與代孕規範不明等問題。本文建議完善修法,確保人工生殖制度兼顧平等、多元與生殖自主權,推動真正的生殖平權。
This paper examines the necessity and challenges of amending Taiwan’s Assisted Reproduction Act after the legalization of same-sex marriage. The current law applies only to married heterosexual couples, excluding single women and same-sex partners, forcing LGBTQ+ individuals to seek reproductive services abroad at high costs and medical risks. In 2024, the Ministry of Health and Welfare proposed amendments to include single women, lesbian couples, and legalize surrogacy. However, the bill still has issues such as age restrictions, limited donor information access, and unclear surrogacy regulations. This paper advocates for comprehensive reforms to ensure equality, diversity, and reproductive autonomy.
