The Practice and Limitations of Marriage Migrants’ Right to Health in Taiwan: A Focus on Regulatory Changes in HIV
本文擬從法律史的脈絡,佐以健康權理論解析臺灣婚姻移民的健康權實踐與局限。具體來說,將以HIV的規範與相關裁判為分析文本,考察以國籍為中心的制度設計,可能忽略的移民身分與傳染病治理、社會弱勢性等交織下的健康權實踐困境,從而省思政策與法律之設計應考量的脈絡因素,避免再生產健康不平等。
This study analyzes the realization and structural limitations of the right to health of marriage migrants in Taiwan through a legal-historical lens, informed by right-to-health theory. Focusing on HIV-related regulations and relevant judicial decisions, it examines how a nationality-centered institutional framework shapes and constrains the exercise of the right to health under conditions where migrant status, infectious disease governance, and social vulnerability intersect. By situating public health regulation and judicial reasoning within their historical and institutional contexts, this study highlights the contextual factors that law and policy design should take into account in order to avoid the reproduction of health inequalities.
