從臺灣食品安全法制論行政調查之實施【本期企劃】 試閱
A Study on the Implementation of Administrative Investigations Focusing on the Legal System of Food Safety in Taiwan
當主管機關欲作成與食安有關之決定時，必須依據正確之事實。因此，與食安有關之行政調查，即具有重要性。本文即就臺灣現行食安法制中與行政調查有關之問題，如在從事調查行為時，其應遵循之法律原則及程序要求，法規是否充分？人民在調查過程中，倘權利受到侵害時，有無即時救濟之機會？調查強度是否足以因應行政調查之需求，以發揮其應有之功能？就此本文將進行探討，並提出改進建議。
The competent authorities make decisions regarding food safety in accordance with the correct facts, the administrative investigations about food safety therefore become essential. The issues of administrative investigations regarding the current legal system of food safety remain unclear, such as the legal principles and the procedural requirements of investigation actions, as well as the sufficiency of related regulations; the timely remedies for people whose rights are violated during the investigations; and the density and the efficacy of the investigations. This article has a thorough study and provides suggestions to the mentioned questions.
