From the Dead End of Anonymization to Solutions for the Future of Data Protection: Perspectives on the Gaia-X Ecosystem Against the Backdrop of the Need to Uphold Digital Responsibility Goals
本文提出三大核心問題：當前的資料匿名化能否徹底實現，這對個人資料使用意味著什麼，以及如何開創一個資料管理的新模式，讓個人在充分知情的基礎上掌控對自己資料的主導權。圍繞這些問題，本文先概述資料再識別的研究現狀，剖析不斷加劇再識別風險的技術和監管環境；再針對隱私權與資料促進創新之間的緊張關係，分析資料倫理方面的挑戰；最後勾勒出邁向自主決定型資料社會的範式轉變—這種社會有技術、法律與理念作基礎，能夠構建出一個可實現資料自由流動的數位生態系統。
This article examines the issues of how anonymous our data really is today, what conclusions we want to draw from this for the use of personal data and how we can break new ground in data management with the informed and sovereign individual at the center. To this end, it will provide an overview of re-identification research as well as the technological and regulatory environment that is increasingly promoting the risks of re-identification. It further discusses the data ethics challenges in the area of conflict between the right to privacy and the use of data as a driver for progress and innovation. A paradigm shift for a self-determined data society is finally outlined, which has the technical, legal and idealistic foundations to create a digital ecosystem in which data can flow freely.
