縱貫職業安全衛生法歷史的RCA事件:談職業傷病預防中的勞工參與【本期企劃】 試閱
RCA Event through the History of Occupational Safety and Health Act:Employee Participation in the Prevention of Occupational Diseases
職業傷病常對遭遇傷病的勞工帶來嚴重且可能無法回復之傷害。隨著人口與產業結構的轉型,勞動力作為產業發展的重要資產,越顯稀少且珍貴,而職業傷病所造成的勞動力損失,以及後續所衍生的社會問題,也成為無法忽視的沉重社會負擔,故職業傷病預防理所當然的成為重要的議題。但實務上,在職業醫學從認定與補償轉向預防與重建的過程中,職業傷病的預防卻遇到了許多挑戰,本文試圖從發生在臺灣的重大職業傷病案例─RCA事件出發,分析這個縱貫職業安全衛生法歷史的重要事件,同時反映職業傷病預防機制的缺陷,並從過去文獻及臺灣大學工會的實務經驗出發,探討勞工參與如何融入並改善既有機制。
Occupational injury and illness often bring severe and possibly irreversible damage to the worker. Along with the transformation of population and industrial structure, as the important assets of industrial development, fewer and fewer labor force has become more and more precious. The labor loss caused by occupational injury and illness, and the upcoming social issues have become a heavy social burden we could not ignore. Thus, the prevention of occupational injury and illness has become an important issue. However, in practical terms, when the focus of occupational medicine shifts from recognition and compensation to prevention and reconstruction, the prevention of occupational injury and illness faces many challenges. Based on an important case of occupational injury and illness in Taiwan, RCA event, this article tries to analyze it and figure out the defect in the prevention mechanism of occupational injury and illness, and the way how employee participation could integrate and refine the existing mechanism would be discussed according to the previous literature and the practical experience of Labor Union of Taiwan University.
