A Medical Lawsuit about a Hospitalized Patient Who Sank into Unconsciousness: Analysis of Medical Behavior in Contractual Obligations and Moral Obligations
The medical behaviors are provided by medical providers usually involves multiple and complicated inspection and treatment procedures. It is important how to calculate and determine the number of medical contracts. At same time, it will also discuss whether the signature of the patient’s family member in the medical procedure or the examination consent form indicates that he has concluded the contract. This paper will further analyze that in the case, if the contract is not concluded, whether the medical behaviors given by the medical provider is positioned as a moral obligation. How to find the connotation of moral obligations, the criteria for determining morality of obligations, and the tension between contractual obligations and moral obligations are the core of the discussion in the second part of this paper.
