Review of the 2018 New Regulations in the Mainland China ─ “Internet + Healthcare”: New Issues and Rule-makers’ Responses
在中國大陸,「互聯網+醫療」因國家政策的推動得以興起並發展。為了彌補傳統醫事法規應對線上醫療的不足,中國國家衛生健康委員會於2018年發布新規並予以試行,成為當前「互聯網+醫療」適法運作的根本性依據。新規的亮點在於:提出互聯網醫院的准入條件;限定通過訊息通訊設備遠距離提供醫療服務的範圍;明定在線醫療各參與主體的醫療責任分配規則。此外,新規也在如何出具在線處方、管理醫療訊息,以及保障患者的知情同意權等問題上,提出了基本性的要求,而相關要求尚待未來進一步細緻化。
“Internet + Healthcare,” a government-backed industry, has become an emerging innovation in the mainland China and meanwhile brought about new issues, for which no correspondent rules could be found in the pre-existing medical laws. As a response to those issues, the National Health Commission in the central government promulgated new administrative regulations in 2018. They highlight the registration system of the internet hospital, the precondition of performing telemedicine and the rule of deciding legal liabilities of the remote doctor and the third party responsible for maintaining the good state of the online medical service. Besides, new rules in them also concern the online prescription, the security of medical information and the protection for the patient informed-consent, which, however, should be concretised in the future by the legislator or rule-maker.
