A Study on the Mental Capacity- Focus on the Judgments of the Court
According to the latter paragraph of Article 75 of the Civil Law: "An expression is also void which is made by a person who, though not without capacity to make juridical acts, in a condition of unconsciousness or mental disorder." How to explain the "unconsciousness or mental disorder" in this provision has many cases in practice. If it meets the requirements of the latter paragraph of Article 75 of the Civil Law, the expression of intention is still invalid.
