食品內的填充物向來使用氮氣作為保鮮用途,但觀察臺灣的實務可以發現,填充用的氮氣究竟屬於食品的一部分或是添加物,其實欠缺明確的定義;其次,對於食品級氮氣的標準也未見清晰,前述兩個問題都將與食安法第49條第1項的刑事規定產生連動關係,實應及早釐清為妥。

英文摘要

Nitrogen has always been used for food preservation purposes. However, in Taiwan’s practice, it can be found that there is no clear definition of whether the nitrogen used for filling is part of the food or an additive. Secondly, there is no standard for food-grade nitrogen. Both of the issues mentioned will be closely connected to the criminal provisions of Article 49, Item 1 of the Act Governing Food Safety and Sanitation, and it should be clarified as soon as possible.
