Infertility due to Bilateral Oophorectomy: Scope of Compensation Regarding Deprivation of the Right of Procreation
本件為23歲罹患卵巢皮樣囊腫之病人，遭醫師術前未盡告知義務即行切除雙側卵巢致其喪失生育能力事件，第一、二審法院均認病人敗訴，經最高法院廢棄發回後，於更一審和解。本文係就此違反告知義務類型之損害賠償責任與範圍，以及生育能力遭侵害應否及如何賠償二議題，提出評析意見。
A 23 year-old victim who suffered from dermoid cysts of ovaries, was operated. Bilateral oophorectomy was performed without informed consent. The plaintiff fileda claim for the compensation including the expense of IVF but the claim was declined by district court and high court. The supreme court reversed and remanded, and settlement was made thenafter. This article will comment on the liabilty of this event with special reference to the compensation regarding deprivation of the right of procreation.
