英文摘要

The main issue of this case involves whether physicians have a general duty to disclose to patients their experience operating on particular surgery and the number of failed operations. In the US, the court in general does not recognize such a general duty. However, some courts do recognize a more limited duty in scenarios where physicians are responding to patients’ questions on physician-specific risk information. In states where the court adopts this view, relevant evidence would be admitted, such as published statistical data on the relative risk and evidence on the availability of these data, to determine if physicians have misled patients and committed negligence tort. The specific fact of this case does not involve physicians responding to patients’ questions. It remains to be seen if cases of similar nature will arise in Taiwan in the near future.
