Alternative Dispute Resolution on Medical Disputes
醫療事故預防及爭議處理法於2022年6月間立法通過，預計於2023年施行，本文於新法施行之際，爰以「醫療糾紛之訴訟外紛爭解決機制」為題進行探討，例如：和解、調解、調處、仲裁等，本文主要探討調解制度，並比較調解與其他機制之差異性；而於比較法部分，分析美、德、日、韓等國之調解機制。此外，本文亦討論於調解成立時，民、刑訴訟是否有與確定判決有同一效力。
The Act on the Prevention of Medical Incidence and Settlement of Disputes has passed on June 2022, and carry out on 2023, this article is going to discuss the topic of “Alternative Dispute Resolution (ADR) on medical disputes” during the implement of this new law, because there are many alternative dispute resolutions, for example: conciliation, mediation, arbitrate and etc., we focus on the topic of mediation, and compare the difference between mediation and other ADR, and also compare mediation in other country, for example: America, Germany, Japan and Korea. In addition, this article discuss whether civil and criminal litigation have same legal effect like final decision.
