天差地別的境遇：墜入蛾摩拉城的精神障礙犯罪者【本期企劃】 試閱
From Heaven to Hell: Mentally Ill Offenders Fall into Gomorrah
由於近年發生多起與精神障礙者犯罪有關之社會高矚目案件，故政府制訂「社會安全網計畫」作為因應並預防此種現象發生，在法律方面增修現有法律制度，例如精神衛生法、刑法、刑事訴訟法、保安處分執行法等，但因為各法律目的與規範不同，造成精神障礙者只因為犯罪而導致其在處遇上產生天差地別的結果，故本文從法律與處遇的觀點上作比較，使這些問題更明確此類精神障礙者在觸法後所面臨的困境。
Due to several incidences of high-profile criminal cases which seemed to be connected with mentally ill patients took place in our society, our government made a special project, so-called “Social Safety Net Project”, to be reactive and proactive toward these. Several laws such as Mental Health Act, Criminal Code, Code of Criminal Procedure, Rehabilitative Disposition Execution Act had been amended for above purposes. Whereas each law had its own legal and normative goal , some conflicts between them may occur after amendments. Accordingly mentally ill patients may fall from heaven into hell just because they committed crimes under the influence of mental disorders. This article is going to elucidate this predicament of these mentally ill offenders through comparative viewpoint of above laws and treatment.
