醫療事故預防及爭議處理法歷經立法院審議多年，終於成功立法，而對此法所欲預達成之立法目的以及所採取的立法措施，本文採取鳥瞰式介紹，而將重點放在立法後可能衍生之民事請求權基礎，並對於此次立法所未解決的問題提出本文見解。

The Act on the Prevention of Medical Incidence and Settlement of Disputes has been scrutinized by the Legislative Yuan for many years and has finally been successfully enacted. This essay takes a bird’s-eye view to introduce it, focusing on the basis of civil claims that may arise after the legislation, and provides opinions into the problems that have not been resolved by the legislation.
